With dementia now the main cause of death in the UK, may be more important than before to consider what will happen to you even become paralyzed and cannot make decisions for yourself.
The solution, if you have the opportunity to think about it, is an eternal power (LPA), where you contribute the power to handle your financial affairs and/or health care to trusted people, known as lawyers.
There is a separate LPA for financial problems and health problems. Each of them gave instructions for lawyers and freedom to make decisions on behalf of someone who had lost mental capacity to make the decision itself.
You can nominate more than one lawyer and lawyer is bound by the task to act for the best interests of donors. Until 2007 LPA was known as the power of lawyers who lasted a long time, but this was open to abuse and the law was changed.
The LPA did not begin until someone lost capacity, while EPA started from it signed. If you issue EPA, it is still possible valid.
Long-lasting power of attorney can help with daily decisions if you lose capacity and many law firms have a specialist team to deal with eternal power of attorney. But what if a loved one loses capacity and hasn’t nominated a lawyer?
Become a representative
In this case you can submit an application to the Protection Court to become someone’s representative. As long as there is no lawyer, and the court agrees that the person has lost the capacity to make a decision for themselves, you can be appointed as a representative.
If there is a power of attorney, the court will not rule out the person’s decision to appoint that person, so you must always check that there is no lawyer before you make an application to become a representative. If the lawyer has died, has been deleted, or has lost his own capacity, you can make an application to become a representative.

How long will you be a representative?
It took a long time, usually about 6 months, to be a representative. During that time you could not make a decision on the name of that person or made any financial transactions (such as paying bills) until there was. If there is no direct debit on the spot, you need to contact any creditor and make financial arrangements.
If you pay bills from your own money, you will be able to pay yourself after receiving a deputy from the court. But the money cannot be taken from funds from people who cannot afford until a representative is given.
That’s expensive
Because various parties involved are expensive processes too. But this is because the level of supervision is much higher than if someone is donated by a long -lasting power of attorney. The court will need proof of a person’s limited capacity and this medical report must be paid in advance (and cannot come from the funds of the poor).
As part of the family process or close friend of people who cannot be told and time is given to them respond, if there is an objection.
Court fees must be paid in advance as well, but again this can be paid from funds from people who cannot afford after the deputy has been given.
But … you get help
A deputy is supervised, who can be useful for people who have never done it before. Every year a representative is required to submit a report to the public guard office, detailing all income and expenses. This is designed to protect loved ones. You will also be asked to pay for annual insurance (which can come from funds from people who cannot afford) if there are financial errors, such as using the person’s money in a way that is not permitted by deputy orders.
Last thought
No one knows the future, but it makes sense to plan ahead where you can. Getting an eternal power of attorney is the easiest choice and can really help in terms of daily decisions. You will also have more input if you make a decision while you can.
The power of power that lasts only starts only if you lose the capacity to make a decision for yourself.
